Ethics, Bioethics, Law Basic Principles and Main Approaches

Abstract

This paper has two principal aims. First of all it deals with the introductory concepts of ethics fi eld of study such as morality, duty, ethics and bioethics together with the distinctive characteristics of each terms. While trying to give the methodological vision of the evolution from morality to bioethics in historical and societal perspective, it clarifi es the main principles of bioethics by giving special emphasis to universal and global points of view. Secondly it means to defi ne and explain the interactive relationship between ethics and law basing on the features peculiar to these disciplines that aff ect each other reciprocally. It explains the main approaches in exemplifi cation of fateful cases in near history of ethics and health law debates. It ends with predictions of the interaction between bioethics and law to reshape and transform to the benefi t of each other giving birth to health law

Abstract

Bu çalışmanın iki ana hedefi vardır. İlk olarak ahlak, etik, ödev, görev ve biyoetik gibi etik çalışma alanının temel kavramlarını ayırıcı özellikleri ile tanımlamak amaçlanmıştır. Bunun için etik çalışma alanında tarihsel ve toplumsal bakış açısı ile ahlaktan biyoetiğe evrilen süreç tanımlanmaya ve bunu yaparken evrensel biyoetik perspektifi korunmaya çalışılmıştır. İkinci olarak biyoetik ve hukuk disiplinlerinin birbirlerini karşılıklı etkiledikleri yakın geçmiş süreci, literatürden örnek vakalar ile açıklanmaya çalışılmıştır. Sonuç olarak, bu karşılıklı etkileşimin ürünü olarak yakın dönemde doğan ve gelişmekte olan sağlık hukukunun kısa tarihi ve geleceğe ilişkin öneriler vurgulanmıştır
